No other patent application has drawn the kind of interest worldwide as the Bilski case has. And no other patent suit has drawn into the debate, various industry interests, academia, the legal fraternity and the open source community. Filed 12 years, the Bilski case has put under the scanner the flood of business method patents issued in the US in the past decade, and as the case found its way to the Supreme Court, websites and the blogsphere has become cluttered with a plethora of opinions on the merits of the patentability business methods or processes. An indication of the high interest in the Bilski outcome was the long line of people wanting to attend the public hearing — it turned out to be a brief 30-minute session ultimately — in the Supreme Court last Monday.

What is the Bilski case and why is it so critical for a host of interests? The case centres on the US Patent and Trademark Office’s rejection of Bilski’s 1997 application for a computer-assisted method of hedging risk in the energy sector. The application was made by Bernard Bilski and Rand Warsaw who worked at a natural gas utility in Pittsburgh. The two came up with a way to hedge transactions against weather patterns so that a middleman could offer uniform prices to consumers and providers alike. What they devised were mathematical formulas for managing the risks on both sides, and filed a patent application describing a business method built around those formulas. Warsaw was quoted in a news report as saying that theoretically the formula could be worked out mentally or with pencil and paper, but that in practice it requires a computer to crunch enough numbers to make it a viable business. United States Patent and Trademark Office (USPTO), however, rejected the application on the ground that the ‘invention’ “merely manipulates an abstract idea and solves a purely mathematical problem”. In October last year (see ‘Bilski and the madness of methods’, November 12, 2008), the Federal Circuit, a specialised tribunal that hears patent appeals, upheld that patent office decision and Chief Judge Paul Michel held that to get a patent, a process must be “tied to a particular machine or apparatus” or transform “a particular article into a different state or thing”.

There are plenty of examples of how Britain’s fashion industry punches above its weight on the world stage. Burberry, recently elevated into the ranks of the FTSE 100 index, is one of the world’s biggest fashion brands, while many of our designers — such as John Galliano, at Dior — have been sought out by fashion houses elsewhere in the world. Meanwhile, London Fashion Week is firmly established as one of the global fashion industry’s key annual events, rivalling similar events in Paris, Milan and New York. This is despite London, once regarded as brimming with edgy, avant-garde talent, losing many of its best-known designers — including Mr Galliano, Alexander McQueen and Stella McCartney — to Paris and Milan in recent years. This is proof that Britain’s fashion schools are still turning out some of the most innovative people in the industry.

For the petitioner, Bernard Bilski, the issue was whether he’d get a patent on “a method for managing the consumption risk costs of a commodity sold by a commodity provider.” The exchange gave him little reason for optimism. For the rest of us, the crucial question is what rule will be applied for patent eligibility in the future. On that question, the discussion was anything but clear. most egregious software patents. If the Supreme Court signs off on the lower court’swork, it’s reasonable to expect this trend to continue. On the otherhand, if the Supreme Court adopts a less restrictive standard, theproliferation of software patents may resume in earnest.

British fashion label Luella stops trading – Reuters India

LONDON (Reuters Life!) – Luella Bartley, the young British designer whose quirky yet feminine designs have adorned model Kate Moss and singer Lily Allen, has become the latest fashion casualty of the recession.

Bartley’s label, Luella, ceased trading after its ready-to-wear producer closed last month and its main financial backer pulled the plug on any further investment, the company said in a statement emailed to Reuters on Wednesday. Luella Bartley Ltd said its key producer in Italy, Carla Carini, unexpectedly closed last month, leaving the brand unable to fulfil its spring/summer 2010 orders.

Luella Bartley, the Warwick-shire-born designer integral to the recent rejuvenation of British fashion, has become a surprise victim of the recession. Her eponymous label has been forced out of business after one of its main suppliers closed.

It is a shock to those who have followed the progress of Bartley, Designer of the Year at the British Fashion Awards in 2008. On Monday night, it was still business as usual: she hosted a party at the London store Liberty, where she has designed the Christmas grotto and window display. “This is a very disappointing situation for everyone involved,” she said yesterday. “I have had an incredible team around me… and it is upsetting not to be able to protect jobs in this difficult economic climate.” Known for its idiosyncratic and humorous mix of punk details and party dresses, Luella is the label of choice for the streetwise British girl-about-town and is regularly worn by London gossip-page royalty Alexa Chung, Lily Allen and the Geldof sisters. The designer once described her look as “the kind of clothes you can get drunk and fall over in”.

UPDATE 1-Cavium Networks to buy MontaVista Software for $50 mln – Reuters

Nov 10 (Reuters) – Chipmaker Cavium Networks Inc ( CAVM.O )agreed to acquire MontaVista Software for $50 million in cashand stock, to expand into embedded Linux support and services.

Cavium, whose chips are used in the networking,communications, storage and security industries, will pay about$16 million in cash and $34 million in stock.
